Net Neutrality Threatened by Trump Administration

Tom Wheeler, the former chair of the FCC, used his final speech before stepping down to warn businesses and consumers that their choice of cloud services and business applications could be severely limited if the incoming administration strikes down the 2015 open internet order that he and his group put in place. This order positioned the FCC’s net neutrality regulation that prevents Internet Service Providers from slowing or blocking traffic on their networks. This gives all traffic equal opportunity and speed and prevents network favoritism.

Wheeler also showed concern for the Internet of Things, an area of economic growth that is quickly becoming top of mind to many businesses and policy makers in Washington.

“[T]he growth of the internet of things is another area that depends on the open connectivity of those things,” Wheeler said. “If ISPs can decide arbitrarily which IoT device can be connected, or favor their own IoT activity over their competitors, the bright future of IoT dims.” Wheeler continued, “As everything goes into the cloud, the ability to access the cloud free of gatekeepers is essential. If ISPs get to choose which applications and clouds work better than others in terms of access, speed and latency, they will control the cloud future,”.

Wheeler’s position may not be a surprise now but given his past as a lobbyist for the cable and wireless sector his support of net neutrality may come as a shock.

Bill Wilson, a consultant for Broadband Landing, said, “Wheeler may be underplaying the seriousness of the situation. Net Neutrality is the biggest deal that no one really understands. If consumers and small businesses actually realized what the internet would look like after it was bought and sold by large corporations that was be worried. This would be all that was being talked about.”

Wheeler has the same question many businesses do, namely will Trump dismantle a policy that is clearly working? With republicans openly opposed to net neutrality things do seem dire for the policy.

Wheeler’s speech not only acts as a warning to the incoming administration but also clearly attempts to widen the scope of the net neutrality debate as a whole. Consumer impact of the open internet order is almost always the lead in any discussion of net neutrality but here Wheeler’s focus was on the danger to businesses and their increasing use of cloud computing. Interruption or the slowing of these services is a bit more destructive than a video playing slow. Businesses might be required to completely change back office management systems. A company like could have their customer base divided between users that have an ISP that allows their traffic and ISP’s that won’t. Situations of this type could be repeated across many business services. If AT&T buys a firm that provides CMS to sales and marketing groups, it is not unthinkable that they would show preference to this firm over others.

Wheeler specifically calls out Verizon and AT&T for the “zero rating” programs that give some companies free access by not charging customers for the data they use. While this isn’t the feared “Fast Lane” net neutrality has been trying to avoid, it may actually be worse.

Wheeler finished his speech with, “It now falls to a new set of regulators, to a new FCC and to those who advocate before it and the Congress to determine the road that they want to take from here,” Wheeler said. “We are at a fork in that road. One path leads forward and the other leads back to relitigating solutions that are demonstrably working.”

While the fork in the road analogy fits, it’s actually a bit more drastic than Wheeler makes it seem. One road leads forward and the other leads back a decade and then off a cliff into a hole filled with alligators.

MPRDA update: Petroleum perspective

Pursuant to the passing of the Minerals and Petroleum Resources and Development Amendment Bill by the National Assembly and its referral to the National Council of Provinces (NCOP), on Tuesday 8 November 2016, the department of mineral resources (DMR) presented its brief to the NCOP select committee on land and mineral resources on the amendments contained in the Bill as well as its additional proposals to the Bill.
MPRDA update: Petroleum perspective
As it affects the upstream petroleum industry, the DMR stated that some of the additional proposals were the result of comprehensive engagement with the upstream petroleum industry to find a win-win solution for the sector, taking into account its frontier nature in the development of petroleum resources.
Below is a summary highlighting some of the key proposals presented by the DMR to the Committee:

A proposed amendment of the definition of “effective date” so as to give effect to the Mawetse judgment.

A technical amendment to s9 so as to clarify the dual application system whereby the minister is empowered to invite applications for a defined period through a Gazette on unknown areas and provision is made for an open application process on a “first come, first served” basis.

A proposal that the amendments in the Bill relating to the replacement of the designated agency (Petroleum Agency of SA) with regional manager be omitted.

Section 86A of the Bill had been reworked pursuant to comprehensive engagement with the upstream petroleum sector to provide for:

A 20% state carried interest with a cost recovery mechanism of the carried interest during the production stage.

A downward adjustment at production stage in consultation with the minister of finance.

A 10% BEE shareholding (up from 6% according to the DMR).

Certainty of project terms by providing for the determination of terms for both exploration and production rights for the duration of the right.

Renegotiation of terms when renewing a production right.

Relinquishment of contiguous portions of exploration areas at the renewal stage.

Ministerial powers to develop a petroleum charter which would make provision for transformation in the oil and gas sector.

In line with a recommendation made in the portfolio committee on mineral resources report to the National Assembly, that the initial public consultation process was too short, the committee will be starting the consultation process anew. Provincial briefings will take place prior to the public hearings. The Western Cape, KwaZulu-Natal, North West and Mpumalanga have had provincial briefings; and the Eastern Cape is scheduled to have one on 9 December 2016. The Free State, Limpopo, Northern Cape and Gauteng will have the provincial briefings in 2017. All nine provincial legislatures will then schedule public hearings in the new year.

The Institute of Chartered Shipbrokers (ICS) will launch its new Nigeria Chapter of the West Africa Branch of the Institute at the Multimodal West Africa exhibition and conference which is expected to host thousands of representatives from the transport and logistics industry, ranging from road, rail, sea, air to inland waterways in January 2017 in Lagos.

“Capacity building in the commercial shipping arena to contribute to economic growth in Nigeria and the West Africa sub-region is our main target and we are very excited about it,” says Captain Samuel Olarewaju, (FICS), vice chairman, West Africa Branch (Chairman Nigeria Chapter), ICS. He adds: “the Institute represents all aspects of the shipping business and includes in its membership not only shipbrokers but ship-owners, charterers, agents, forwarders and other shipping professionals. It is dedicated to the setting and maintenance of the highest standards in international transport and shipping business.”

ICS to help to meet growing demand

The Institute has a long and proud history in the industry. It was established in 1911, incorporated in 1913, received Royal Charter in 1920 and widened its scope of membership to include the Commonwealth and non-British and lastly South Africa. Currently, there are 25 branches globally, with the head office in London. The Institute membership is mainly through examinations and exposure in shipping. There are 14 international teaching centres and over 100 examination centers worldwide with about 4,000 candidates sitting the exams annually.

Captain Samuel says the Nigerian Government’s plans to increase port and terminal activity “is very timely as it would help meet the growing demand and the need for capacity expansion in our ports.” He continues: “we cannot afford the type of congested seaports experienced in the 70s, particularly now that we are thinking of revamping the economy; as part of the process of the economy revamp concessionaires were brought in, we have concessioned the ports to them and they have brought in a level of efficiency into our port management with useful infrastructures installed. The overstretched infrastructural challenges being faced by the concessionaires have to be taken care of.”

The ICS West Africa Branch vice chairman explains his vision for the shipping industry: “for shipping to be one of the major contributors to the country’s GDP and continual improved economy at large by having ethically and professionally sound people managing the commercial shipping business while everybody involved in shipping have knowledge of the business through training with the Institute at different levels.”

He was chosen for his entrepreneurial spirit, the logistics and fleet management company’s financial performance, his ability to provide strategic direction and innovation, and his integrity and influence.

“I am honoured to have been presented with this prestigious and coveted award given the caliber of candidates nominated this year. I am looking forward to representing SA at the EY International Entrepreneur Award 2017 in Monaco next year,” Mountford said on Wednesday.

Mountford is a chartered accountant with an MBA from Warwick University in the UK. He has been MD of SAB Diversified Beverages, which included SAB’s supply chain services and logistics interests.

He was also MD of Super Group’s logistics and transport division until June 2002, after which he joined Imperial Holdings, where he was CEO of the consumer logistics division for six years.

Mountford was appointed CEO of Super Group in July 2009. He is also a director of the Road Freight Association, which mainly represents road freight service providers.

Since his appointment as CEO, Super Group’s market capitalisation has rocketed from R349m to about R14.5bn, a rise of more than 4,000%.
